Politico is reporting that a directive from the Obama Administration, which was challenged by Texas Attorney General Ken Paxton, has been blocked.
Judge Amos Mazzant, of the Eastern District of Texas, issued an injunction today, halting the rule's implementation. The rule was to take effect on December 1st.
The Department of Labor issued a statement today, expressing disapproval with the Court's decision. A question does remain regarding whether the Labor Department will appeal the decision, especially with a new Labor Secretary to be appointed under President-elect Trump.
Following the injunction, Paxton issued a statement, saying "The Obama administration proved true to form when it ordered the Department of Labor to revise its interpretation of the Fair Labor Standards Act. Namely, the administration assumes that through force of will alone, it could order a new economic reality into existence...Not on my watch.”
Because of Judge Mazzant's injunction, the rule will not take effect on December 1st, anywhere in the United States.
