Fairly's Legal Team Asks for Deadline Extension for Appeal Brief

The legal team for businessman Alex Fairly filed a motion asking to extend the deadline to file their opening brief in an appeal of his successful lawsuit against the City of Amarillo.

While the ruling released in October was in Fairly’s favor and invalidated the tax anticipation notes, both parties have filed briefs in the Seventh Court of Appeals seeking oral arguments to appeal the ruling. The City of Amarillo is looking to challenge almost every aspect of the ruling, while Fairly’s team is seeking an even stronger judgement against the city.

Opening briefs are currently due on February 21st, though Fairly’s team has requested moving the deadline to March 23rd, “so that counsel may have adequate time to prepare the brief.” Fairly’s legal team also notes that, after reaching out to the city, the city’s legal team “does not oppose this request for an extension of time.”

Fairly announced on Wednesday morning he will not run for Mayor of Amarillo. In his announcement, he encouraged Councilman Place 1 Cole Stanley to run. Stanley was the only member of the council to vote against the tax anticipation notes and will announce a decision on a mayoral campaign next week.
