Plaintiffs in WT Free Speech Lawsuit Withdraw TRO Motion, Still Seeking Preliminary Injunction

The defendants in a free speech lawsuit against WTAMU President Walter Wendler have withdrawn a motion for a temporary restraining order seeking the court to order the university to allow the cancelled event at the center of the lawsuit.

According to a filing from the plaintiffs, they have raised sufficient funds to secure an off-campus venue. They are still seeking a preliminary injunction to enjoin the university “from prohibiting Plaintiffs from holding future events similar to the one they had planned for March 31, 2023.”

As we previously reported, before the motion for a TRO was withdrawn, Judge Matthew Kacsmaryk ordered the defendants to respond to the motion by Thursday morning. As the motion has been withdrawn, Judge Kacsmaryk has ordered the defendants to reply to the original complaint and motion for a preliminary injunction by April 21st. Any replies to the response by the Plaintiffs must be filed by May 5th.
