This week, local businessman Alex Fairly has given two updates on his ongoing lawsuit against the City of Amarillo regarding funding for improvements to the Civic Center.
His first update, which was posted in the form of a written statement on social media on Tuesday evening, Fairly said that his legal team was “encouraged by Judge Sowder’s decision” regarding his denial of the city’s motion to require Fairly post a $6 million security against suit bond. As we reported earlier this week, the motion was made by the city on July 15th with arguments being made by both sides during a hearing on July 21st.
In the post, Fairly also promised an opportunity for “Amarilloans to take an active part in this process.”
Fairly followed up on that promised by posting a video to Facebook earlier today, announcing a petition drive seeking to require the council to revisit the issue and potentially returning the issue to the ballot. (As we have previously reported, one of the central contentions of Fairly’s lawsuit is that the tax notes approved by the council for financing the project are essentially the same as the Prop A package rejected by voters in 2020.)
Fairly noted that, even with the petition process having begun, “the lawsuit will continue.” In his video, Fairly stated that the petition drive is “simply another front to open up in this fight.” He further stated that he hopes to soon provide information about how citizens can get involved with the petition.
