Texas Supreme Court Justice John Devine will appear on the Republican primary ballot in March, after all.
On Thursday, the Texas Supreme Court rejected candidate Brian Walker’s petition to remove Devine from the primary ballot. Walker, who is challenging Devine in the upcoming primary election, argued in a court filing last week that Devine was ineligible to appear on the ballot due to receiving an inadequate number of signatures on his ballot application.
In a per curiam opinion — in which Devine did not participate — the Court ruled that Walker was not entitled to the relief he was seeking. Walker had sought to compel Texas Republican Chairman Matt Rinaldi to reject Devine’s application for the ballot.
With the Supreme Court’s opinion, Republicans will decide the race between Devine and Walker on Tuesday, March 5. The winner of the primary will move on to face the Democratic nominee for the seat in November.
